Terms of Service
1. About these terms
These Terms of Service form a binding agreement between you and MedLog LLC, a Delaware limited liability company (pending formation) ("we", "us", "MedLog"). By creating an account or using MedLog you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.
2. What MedLog is (and isn't)
MedLog is a personal health diary. It records what you tell it. It does not diagnose, interpret, or recommend treatments. Any patterns surfaced are statistical observations of your own data, not medical conclusions.
MedLog is not: a medical device, clinical decision support, telehealth, pharmacy, EHR, lab information system, substitute for professional medical advice, or a HIPAA Covered Entity or Business Associate.
3. Eligibility
You must be at least 16 years old (or older if your country requires it), able to form a legally binding contract, not barred from receiving services under applicable law, and provide accurate registration information.
4. Your account
You register with an email you control and a password. You must verify your email before completing signup. You are responsible for keeping your password confidential and for everything that happens under your account. One person, one account.
5. Your content & licenses
Everything you put into MedLog is your content. You own it. You grant us a limited license to host, process, encrypt, transmit, and display it solely to operate the Service for you. We do not use your content for advertising, marketing, training AI models, sale to third parties, or any purpose other than running MedLog.
6. Acceptable use
You agree not to: use the Service for anyone other than yourself or a household member you have authority over; reverse engineer or scrape; bypass security; abuse automated tools; upload illegal or infringing content; impersonate another person; or violate applicable law.
7. Privacy & data
Our handling of your personal data is described in our Privacy Policy. We encrypt your health entries at rest, don't sell your data, don't show ads, don't train AI on your content, and let you export or delete everything at any time.
8. Medical disclaimer
In a medical emergency, call your local emergency services (US 911, UK 999, EU 112). Do not use MedLog to seek emergency help.
9. Service availability & changes
We provide the Service on a reasonable-efforts basis. We don't guarantee uptime. We may add, change, or remove features at any time, with reasonable notice for material reductions in functionality.
10. Fees
MedLog is currently free. We may introduce paid features in the future with advance notice. We do not monetize through your content.
11. Termination
You can delete your account anytime in settings. Your data is removed from active systems immediately and from encrypted backups within 30 days. We may suspend or terminate accounts for Terms violations.
12. Warranties & disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or uninterrupted operation.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages. Our total aggregate liability is limited to the greater of (a) what you paid us in the 12 months preceding the claim, or (b) US $100. Nothing limits liability for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence.
14. Indemnification
You agree to indemnify us from claims arising from your use of the Service in violation of these Terms or applicable law. Does not apply where prohibited by your country's law.
15. Disputes, arbitration & class waiver
Contact us first and give us 60 days to resolve informally. US residents: disputes go to binding individual arbitration under AAA rules, seated in Delaware. You waive jury trial and class actions. You may opt out within 30 days of first accepting these Terms. Small-claims court actions are excluded. Other jurisdictions: see sections 16 and 17.
16. Governing law & jurisdiction
Governed by Delaware law. Delaware courts have exclusive jurisdiction (where not subject to arbitration). Your mandatory local consumer protections still apply.
17. Regional provisions
You may have additional rights depending on where you live. The summaries below are informational only.
California: CCPA/CPRA rights to know, delete, correct, and limit use. We don't sell or share personal info for behavioral advertising. Colorado, Connecticut, Utah, Virginia, Texas, Oregon and similar: equivalent rights under your state law. MedLog is subject to the FTC Health Breach Notification Rule. We are not a HIPAA Covered Entity.
UK GDPR and DPA 2018 apply. Rights of access, rectification, erasure, restriction, portability, objection. Complaints to the ICO. Your statutory rights under the Consumer Rights Act 2015 are not affected.
GDPR applies. Full data subject rights. Complaints to your national DPA. Health data is special category under Art. 9; we rely on your explicit consent. Mandatory consumer protections override anything inconsistent in these Terms. EU consumers may use the European Commission Online Dispute Resolution platform.
PIPEDA applies federally; provincial laws (PIPA, Law 25) may also apply. Complaints to the federal or provincial Privacy Commissioner.
Privacy Act 1988 and Australian Privacy Principles apply. Complaints to the OAIC. Australian Consumer Law guarantees cannot be excluded.
Privacy Act 2020 applies. Consumer Guarantees Act 1993 and Fair Trading Act 1986 protections preserved.
Local data protection laws apply: Japan (APPI), Singapore (PDPA), India (DPDP 2023), South Korea (PIPA), Philippines (Data Privacy Act 2012), Hong Kong (PDPO), Thailand (PDPA), Malaysia (PDPA 2010). If you are in mainland China, Iran, North Korea, Cuba, Syria, or Crimea, the Service may not be available.
Local laws apply: Brazil (LGPD), Mexico (LFPDPPP), Argentina (PDPA 25,326), Chile, Colombia, Peru, Uruguay equivalent national laws. Mandatory local consumer protections cannot be waived.
Local laws apply: South Africa (POPIA), Nigeria (NDPA 2023), Kenya (DPA 2019), Egypt (Law 151/2020), Ghana (DPA 2012), and other national laws.
Local laws apply: UAE (PDPL), Saudi Arabia (PDPL), Israel (Privacy Protection Law 5741-1981), Turkey (KVKK).
18. Changes to these terms
We may update these Terms with at least 30 days' notice for material changes. Continued use after the effective date constitutes acceptance.
